Conditions.<\/span><\/p>\n<p><b>Clear:<\/b><span style=\"font-weight: 400;\"> Means the software called &#8220;Clear&#8221; property of CLEARCHECK M\u00c9XICO SA DE CV<\/span><\/p>\n<p><b>Confidential information:<\/b><span style=\"font-weight: 400;\"> It has the meaning attributed to it in clause h of these Terms and Conditions.<\/span><\/p>\n<p><b>Technology Partners:<\/b><span style=\"font-weight: 400;\"> Any company affiliated with CLEARCHECK M\u00c9XICO SA DE CV that has the express authorization of ClearCheck to be considered as such.<\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element-4ab515f3 elementor-widget elementor-widget-text-editor\" data-id=\"4ab515f3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">ClearCheck products are offered under license; Therefore, at no time should the contracting of such products be understood as a sale.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Client agrees that the software that is the object of this contract is the software called &#8220;Clear&#8221; and that the license contracted hereby will be governed by the provisions of the contract that the Client signs with ClearCheck in order to contract said licenses.<\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1ac06232 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1ac06232\" use<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<div class=\"elementor-element elementor-element-329d3a2c elementor-widget elementor-widget-text-editor\" data-id=\"329d3a2c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Client accepts that he is only authorized to use the ClearCheck products as will be implemented for use by ClearCheck under the terms and conditions established by the contract that the Client enters into with ClearCheck in order to contract said licenses.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Therefore, the Client accepts that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You will only be able to use the contracted ClearCheck products while the contract that the Client signs with ClearCheck in order to contract said licenses remains in force.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You may not install or deploy unauthorized software by ClearCheck to your products.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You will not override or attempt to circumvent the technical, security, or systems limitations implemented by ClearCheck to protect the use of its products.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It will not apply reverse engineering or any other corporate espionage method in order to replicate ClearCheck products or for any other purpose not provided for by the contract that the Client enters into with ClearCheck in order to contract said licenses.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ClearCheck may, at any time, withdraw the license from The Client for breach of any obligation provided in the contract that the Client signs with ClearCheck in order to contract said licenses, without any refund and \/ or compensation to the Client. .<\/span><\/li>\n<\/ul>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-42667b86 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"42667b86\" contracted licenses<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a1d81a0 elementor-widget elementor-widget-text-editor\" data-id=\"1a1d81a0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Without prejudice to the power to terminate the contract that the Client signs with ClearCheck in order to contract said licenses, in advance in accordance with the provisions below, said contract will begin its validity as of the effective date, described therein. , and will continue for a subscription period specified therein; Subsequently, said contract will be automatically renewed for consecutive periods of equal duration to the initial subscription period unless either party notifies the other Either party may terminate said contract in the event that the other party breaches this contract and does not remedy the notification of breach within fifteen (15) days (five (5) days in the case of non-payment). as of the receipt of the notification of non-compliance. elementor-top-section elementor-element elementor-element-7e410677 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7e410677\" loss of data, privacy, confidentiality or profits; nor the inability to use ClearCheck products.<\/span><\/p>\n<\/p>\n<p><span style=\"font-weight: 400;\">These exclusions will be applicable even if ClearCheck and \/ or The Client has been advised of the possibility of such damages and The Client wishes to continue with the contracting of this license of use.<\/span><\/p>\n<\/p>\n<p><span style=\"font-weight: 400;\">All technology and services provided by ClearCheck are provided under the terms and conditions of the contract that the Client signs with ClearCheck in order to contract said licenses, and therefore ClearCheck hereby rejects and denies any implied warranties. ClearCheck does not guarantee that the service will be free from errors or interruptions. ClearCheck shall not be liable for any direct, indirect, special, consequential, or secondary damages and \/ or losses in connection with the program. Without limitation, all the laws related to privacy and data protection in force in Mexico. ClearCheck M\u00e9xico SA de CV and its technology partners will not sell or rent to third parties any information related to a consumer, unless said sale or lease is carried out in a manner consistent with federal, state and local laws and complies with one or more of the following conditions: 1) You have the authorization of the corresponding Client for such use of the data; 2) The data is used for reporting or benchmarking purposes; or 3) The data is anonymous dissociated in such a way that it does not include the names of Clients, addresses or other information that constitutes personal data in terms of applicable legislation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the signing of this contract, the express consent of the owner of the information is established in this case the Client for the treatment of their data as required by article 08 of the Federal Law on Protection of Personal Data in possession of individuals.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">ClearCheck represents that it has established and will maintain security programs and reasonable measures that (i) comply with any security and privacy laws or regulations and (ii) that have been designed to guarantee the security, confidentiality and integrity of the personal data of the consumers that, where appropriate, they obtain, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties.
